Using this site indicates that you have read and accept these Terms & Conditions, The Rank One Terms of Use notice, and The Rank One Privacy Policy (collectively called “Terms”). If you do not accept these Terms, you are not authorized to purchase The Rank One products through this site.
These Terms govern your use of the site, any content (such as text, data, information, software, graphics, or photographs) that The Rank One India may make available through the site (“Materials”), and any services that The Rank One may provide through the site (“Services”). The site, Materials, and Services are referred to in these Terms collectively as the “The Rank One India Website”.
The Rank One (“The Rank One”), in association with Siv, provides you The Rank One Siv Offline Store (“Store” or “The Rank One India Website” or “The Rank One India Siv Offline Store”) services subject to the notices, terms, and conditions set forth herein. In addition, when you use any The Rank One – Siv Offline Store service, you may be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, which may be incorporated by reference.
The Rank One reserves the right to change the services provided through The Rank One and/or these Terms at any time. The Rank One retains the right to deny access to anyone whom we believe has violated these Terms. The Rank One authorized reseller/partner shall be responsible for accepting your orders, collecting payments, and supplying the listed products or services as per your order.
The Rank One website is provided “as is” and “with all faults,” and the entire risk as to the quality and performance of The Rank One website is with you. Except as otherwise stated in these Terms, should the Materials or Services prove defective, you, and not The Rank One India, assume the entire cost of all necessary servicing and repair.
The Rank One India expressly disclaims all warranties of any kind, whether express, implied, or statutory, with respect to The Rank One website (including, but not limited to, any implied or statutory warranties of merchantability, fitness for a particular use or purpose, title, and non‑infringement of intellectual property rights).
Without limiting the generality of the foregoing, The Rank One India makes no warranty that The Rank One website will meet your requirements or that The Rank One website will be uninterrupted, timely, secure, or error‑free, or that defects in The Rank One website will be corrected. The Rank One makes no warranty as to the results that may be obtained from the use of The Rank One or as to the accuracy or reliability of any information obtained through The Rank One. No advice or information, whether oral or written, obtained by you through The Rank One or from The Rank One Parties shall create any warranty. The Rank One disclaims all equitable indemnities.
Certain areas of The Rank One (for example, chat rooms or customer ratings and review areas) may permit you to submit feedback, information, data, text, software, music, sound, photographs, graphics, video, messages, or other materials (each, a “User Submission”).
By submitting a User Submission, you grant to The Rank One an irrevocable, perpetual, transferable, non‑exclusive, royalty‑free, worldwide licence (sub‑licensable through multiple tiers) to:
The Rank One reserves the right to display advertisements in connection with User Submissions and to use User Submissions for advertising and promotional purposes. The Rank One may, but is not obligated to, pre‑screen User Submissions or monitor any area of The Rank One through which User Submissions may be submitted. You agree that you are solely responsible for all of your User Submissions.
The Rank One is not required to host, display, or distribute any User Submissions on or through The Rank One and may remove at any time or refuse any User Submissions for any reason. The Rank One is not responsible for any loss, theft, or damage of any kind to any User Submissions. Any User Submission will be considered non‑confidential and non‑proprietary.
By submitting a User Submission to The Rank One, you agree and warrant that:
The service provider may provide products (such as hardware or software), services (such as maintenance, installation, or training), or access to The Rank One India website under the terms of a separate agreement between you and the service provider (“Other Agreement”). Those obligations are governed solely by the applicable Other Agreement.
For example, use of any software made available to download from The Rank One (“Software”) is governed by the end‑user licence agreement, if any, accompanying such Software. You may not install any Software that is accompanied by or includes a licence agreement unless you first agree to the licence terms.
The Rank One products contained in The Rank One are trademarks of The Rank One and its suppliers or licensors and may not be copied, imitated, or used, in whole or in part, without prior written permission. Ownership of all such trademarks and the goodwill associated therewith remains with The Rank One or the applicable trademark holder.
You may not use any meta tags or other “hidden text” utilizing any name, trademark, or product/service name of The Rank One without prior written permission. The look and feel of the site (including page headers, custom graphics, button icons, and scripts) is also protected trade dress of The Rank One.
Neither The Rank One India nor the service provider guarantees that the information on the Store is correct or accurate at all times. In the event that information regarding a product is found to be incorrect for any reason, the service provider shall have the right to refuse or cancel any orders placed for such product(s). If your card has already been charged for such a cancelled order, the service provider shall issue a refund to your original mode of payment up to the original amount paid.
The Rank One may, in its sole and absolute discretion, change these Terms from time to time. The Rank One will post notice of such changes on the applicable site. If you object to any such changes, your sole recourse shall be to cease using The Rank One. Continued use following notice of any such changes indicates your agreement to be bound by the updated Terms.
You can place orders for any of the products listed in the offline stores or website. Acceptance of an order is subject to both payment receipt and stock availability. The service provider reserves the right to refuse to execute any transaction(s) with any customer without assigning any reason, unless otherwise directed by The Rank One India.
Upon receiving the payment, an order number is auto‑generated and sent to the email ID provided by you at the time of placing the order. Orders once placed with payment cannot be cancelled; if the customer requests cancellation, cancellation charges may apply.
You can use various payment methods, including credit/debit cards, EMI offers through select banks, and net banking available on the site. Card and net‑banking information is secured using SSL technology and is handled by payment gateways.
The Rank One will communicate with you about your order and purchased products through email, SMS, and telephone. You are requested to provide a valid email address and phone number while registering.
When you visit the site or send emails to The Rank One India, you are communicating electronically. You agree that all notices, disclosures, and other communications that The Rank One provides to you electronically satisfy any legal requirement that such communications be in writing.
The liability, if any, of The Rank One towards a user under this agreement shall be limited to the amount payable by the user to the service provider. Neither the service provider nor The Rank One shall be liable for any indirect, special, or consequential costs or damages of any nature, including but not limited to lost revenues or profits, downtime costs, loss or damage to data, or other intangible losses, arising out of or in any way connected with the use of this website, products, and/or services.
By registering on the website, you confirm that the use of the website shall be for personal purposes only and not for any commercial purpose. The right to access, use, deal with, or transact on the website cannot be assigned to any other person. You are solely responsible for safeguarding your login credentials.
You shall at all times fully indemnify and hold harmless The Rank One, its officers, directors, agents, employees, and associate companies, from any and all costs, losses, claims, demands, damages, and liabilities, including reasonable attorney fees, arising out of your breach of these Terms, violation of any laws, or infringement of third‑party rights.
Transactions on The Rank One India website shall be governed by, construed, and enforced in accordance with the laws of India. Any disputes arising in respect thereof shall be subject to the exclusive jurisdiction of the courts of Delhi.
The Rank One and its authorized resellers/service providers shall not be liable for any failure or delay in performing any of their obligations under this agreement due to events beyond their reasonable control (“Force Majeure Events”), including but not limited to natural disasters, strikes, acts of government, network outages, or other events listed in the detailed policy text.
